The work of Lawrence Kohlberg has become the central focus in both the research and applied dimensions of moral education. While teachers and academics are generally familiar with Kohlberg's account of his six stages of moral development, his hints about a highest and culminating seventh stage have had no sustained critique. This essay attempts to provide a detailed account and critique of all of Kohlberg's writings dealing with stage seven, from a philosophical standpoint. This essay critiques Kohlberg's analysis of (...) Moore's naturalistic fallacy, and rejects his attempt to disarm the fallacy by adopting a strategy of ?parallelism?, or ?complementarity?. I argue that it might be better to accept the fact that one cannot derive an ought from an is, and then to view ought-claims as selected or preferred is-claims. This allows morality to remain sui generis, and the support for a moral choice must arise from the complete ?story? or world-view in which it is embedded. Stage seven is not just any ?whole story?, however, but the best or ideal whole story. As well, it serves as the answer to the fundamental ethical question, ?but why should I be moral in the first place?? Stage seven gains its justificatory power from its stance of empathetic identification of the moral agent with others, and with the cosmos as a whole, as thinkers as varied as Marcus Aurelius and Teilhard de Chardin have suggested. If stage seven is, as Kohlberg argues, an ethics of love, and if the first six stages are to be thought of as comprising an ethics of justice, then what is to be done if they conflict? Kohlberg deals with this question, and eventually decides in favour of justice, even given the seventh stage as somehow the ground of all normativity in his system. I argue that he cannot consistently adopt a parallelist thesis here, but needs to recognize the normatively fundamental character of his own seventh stage. It serves as his ?whole story?, on which the previous six stages all rest. Kohlberg's own thesis forces him to retain an ethics of justice only until one reaches the level of agape. Then, as with all higher stages, the lower stages are not abandoned, but are taken up and enriched by the thinking and acting which emerge from the higher stage perspective. Neither justice nor agape can stand alone as sufficient basis for an adequate ethics. But it is agape that is the more fundamental, and which enriches justice without rejecting its generally overwhelming claims. Stage seven consciousness simply reminds one that justice is not enough, even though it does constitute the largest part of ethics. (shrink)

The Second Conference of the International Society for the Study of Time was held at Hotel Mt. Fuji, near Lake Yamanaka, Japan, on July I to 7,1973. The present volume is the proceedings at that Con ference and constitutes the second volume in The Study of Time series. * At the closing session of our First Conference in Oberwolfach, Germany, in 1969, I was honored by being elected to the Presidency of the Society, following Dr. J. G. Whitrow, our fIrst (...) President. My mandate was to organize a Second Conference, consistent with the aim of the Society, which is the holding of interdisciplinary conferences for the presentation and discussion of papers on various as pects of time. Several participants expressed to me their wish to have a second conference held in Japan so as to emphasize the international and intercultural dedication of this Society. Dr. Fraser carefully evaluated this and many other suggestions, weighed the possible conference sites and our chances of raising the necessary funds to convene a meeting at such sites, and concurred with my conclusions that we should go ahead with the plans for a Japanese meeting. For the difficult and complicated task of raising funds and organizing a conference in Japan, I had to select and rely heavily on somebody both capable and reliable and also living in Japan. Evaluation of other cultures is a strong force in a culture’s definition of itself. Cultures are formed in encounters that include domination, conflict, and dismissal as much as appreciation and smooth exchange. In this paper, the construction of cultural identity is discussed, with reference to a Scandinavian Theme Park proposal made in cooperation between American design consultants and a local Swedish team of planners and visionaries. The image production in this design proposal, which never came to be realised in architectural (...) production, shows that “Scandinavia” appears as a two-some dialogic construction that adopts stereotyped cultural identities, and that it was not brought to any wider public dialogue. This article focuses on applying some of Žižek’s theoretical work to a specific space within the capitalist conjuncture, the pub. Jürgen Habermas’ influential conception of the public sphere has shown the important role of the caffeine-centric cafés of the past in producing a lively democratic movement. As most any trip to a post-modern coffeehouse will attest, however, such locations have become little more than outlets for free and always individualized Wi-Fi. But the local pub, in the current political climate, has (...) attained something more. The central argument here is that pub culture, built on neither action nor reaction, is the last bastion of anti-capitalism. Indeed, if Bartleby’s “I’d prefer not to,” was an effective response to the demands of capitalism in the work place, then “I’d prefer another” does such duty with even more resistance and relevance for the present. To make this case, and explore its implications, I will turn to key insights from theorists such as Žižek, Lawrence Grossberg, and Deleuze and Guattari, while also comparing and contrasting today’s global pub culture to that of the historical role of the café. Reading the Subaltern Archivally--or, Back to Antiquity Many readers of "Can the Subaltern Speak?" have been disturbed by Spivak's controversial answer to her own question, which is that "no scene of speaking" can arise for the subaltern woman; no discursive space can emerge from which she could formulate an "utterance." 1 One way of rephrasing Gayatri Spivak's highly resonant question might be, Can there be such a thing as a "postcolonial archive"? The purpose of our essay is to demonstrate just how crucial the concept of an "archive"--perhaps even a "postcolonial archive"--is for a more sympathetic understanding of Spivak's now notorious "silencing" of the subaltern woman. The underread and scarcely commented-on third and fourth sections of Spivak's essay raise the question, Can we approach the gendered subaltern more productively if our project is to recover not "lost voices" but rather lost texts? In the process of unpacking the textual complexities underlying Britain's 1829 abolition of sati (the widow's self-immolation on her husband's funeral pyre), Spivak pushes us further back in time when she observes intriguingly that "the archival... work involved here is indeed a task of 'measuring silences'" [286, our emphasis]. 2 We contend that her [End Page 25] choice of the term "archival" is highly motivated and can serve as the long-overdue occasion for a return to the largely unread sections of "Can the Subaltern Speak?"We can think of at least two risks involved in our undertaking. For one thing, revisitations to well-known essays can often seem more regressive than innovative. We are well aware that we may have to overcome a certain indifference on the part of readers who, feeling confident that they know it well, judge that "Can the Subaltern Speak?" (now over ten years old) has had its theoretical "moment" and should now give way to more current efforts to locate nonelite, subaltern subjectivity within a politics of resistance. A second concern is that because our project of reading the subaltern woman "archivally" must necessarily reexamine and justify Spivak's career-long engagement with Derrida and with deconstruction, we must be aware of the extent to which her deconstructive feminism has been prematurely and unfairly associated with the supposed political shortcomings of Derridean deconstruction, the regrettable result being an almost reflex aversion to her deconstructive theory within both feminism and postcolonialism. Despite these risks, however, we hope that our use of the archive as the governing principle for our return to Spivak's essay can pave the way for a more sympathetic reading of Spivak's "silent" subaltern. Several variant "Newtonian" theories of inertia and gravitation are described, and their scientific usefulness discussed. An examination of these theories is used to throw light on traditional epistemological and metaphysical questions about space and time. Finally these results are examined in the light of the changes induced by the transition from "Newtonian" to general relativistic spacetime.

In a previously published multicenter, prospective, randomized, controlled trial of more than 500 intensive care unit patients involved in conflicts over treatment decisions, ethics consultations were found to be helpful in resolving the conflicts and reducing nonbeneficial treatments. The intervention received favorable reviews by 80% of patient surrogates and more than 90% of physicians and nurses. Nevertheless, several participants in the ethics consultation process expressed dissatisfactions with the intervention. In this paper, we report our efforts to determine the factors associated (...) with these negative responses in hopes that we might provide insights of future use to ethics consultants. (shrink)

The thesis of "Freedom of Communicative Action" is that Jurgen Habermas's theory of communicative action illuminated the deep structure of the First Amendment freedom of speech. Haberams's theory takes speech act theory as its point of departure. Communicative action coordinates indivudal behavior through rational understanding. Communicative action is distinguished from strategic action--the use of communication to manipulate, deceive, or coerce. Part I offers an introduction. Part II outlines a hermeneutic approach to interpretation of the First Amendent. Part III explores and (...) criticizes existing theories of the freedom of speech. Part IV explicates Habermas's theory of communicative action. Part V developes a theory of the freedom of expression based on Habermas's theory of communication. Part VI applies that theory to particular problems in free speech doctrine. Part VII draws some conclusions about the implications of this exercise for the development of doctrine and the theory of communicative action. The Aretaic Turn in Constitutional Theory argues that an institutional approach to theories of constitutional interpretation ought to be supplemented by explicit focus on the virtues and vices of constitutional adjudicators. Part I, The Most Dysfunctional Branch, advances the speculative hypothesis that politicization of the judiciary has led the political branches to exclude consideration of virtue from the nomination and confirmation of Supreme Court Justices and to select Justices on the basis of the strength of their commitment to particular positions (...) on particular issues and the fervor of their ideological passions. Part II, Institutionalism and Constitutional Interpretation, engages Cass Sunstein and Adrian Vermeule's recent essay, "Interpretation and Institutions." Sunstein and Vermeule contend that theories of constitutional interpretation are most fundamentally flawed because of their failure to take an institutional turn, but their supporting arguments lead to a related but quite distinct conclusion. Only a theory of judicial character can supply the diagnosis for the ills that Sunstein and Vermeule identify: constitutional theory must take an aretaic turn. Part III, Making the Aretaic Turn in Constitutional Theory, sketches an alternative approach to judicial review and constitutional interpretation that is rooted in contemporary virtue ethics. In Part IV, Constitutional Virtues and Vices, this sketch is given flesh and bones in the form of a theory of constitutional virtue and vice. Excellence in constitutional adjudication requires the virtues of judicial courage, judicial temperament, judicial temperance, judicial intelligence, and judicial wisdom (or phronesis). Most importantly, a virtuous constitutional interpreter must have the virtue of justice, which includes as components impartiality, lawfulness, and legal vision. Part V, The Aretaic Reconstruction of the Institutional Critique, returns to institutionalism as an approach to the theory of constitutional interpretation and argues that institutionalists cannot coherently refrain from making the aretaic turn. All the above views are statements of or from the so-called emotive theory of value, or are closely related to that theory. Where causal primacy lies or whether all these theories and views are effects of a more deep-laid cause is difficult to determine. Nevertheless, the common bonds between the various views are evident; the views themselves are prevalent. Any work which challenges the current subjective intuitionism in matters of "right," "good," and the like stands out in illuminated relief.
